I Tried...

I promised myself I would buck the latest trend. I would not weigh in on the pending Kobe Bryant sexual assault case, but my Irish Ire got the best of me.

Rape is a horribly cruel crime. The mental, as well as physical anguish must be devastating. The media...for the most part... has responded to the eloquent pleas of rape victims and victims' counselors, recognizing the cruelty of the stigma of rape, and agreed to keep out of the newspapers and most other mainstream media the names of those who charge others with rape. Most people feel this is the humane thing to do. I have to ask myself if maybe this has helped proliferate the stigma that is invariably laid upon the victim. But what if the victim's role is recast as merely an accuser? What of the rights of the accused? Wasn't our justice system founded on the principle of "Innocent till Prove Guilty"? The accusation alone may have destroyed the fiscal well being of one of the true superstars in athletics today. What recourse does the accused have? How is he to recover what has been taken from him? I say, we as a society, have an inherent obligation to protect the accused's interests as we do those of the victim, if for no other reason than the accusations may could possibly be false.

I realize the media circus surrounding cases of high profile defendants would render this virtually impossible. But can justice be truly served by naming only the accused...
